claim upon which relief can be granted. The Kansas Court of
Appeals, in 18 Kan. App. 2d 899, 861 P.2d 1372 (1993), affirmed
the district court. This court granted the Dillards' petition for
review. We now affirm the district court and the Court of
Appeals.
