against Patrick Carroll and his automobile liability insurer, for personal injuries and death of Clarence Dillenberg, as the
result of the negligence of Carroll in driving his automobile in which Dillenberg was riding as a guest. Upon a trial of the
issues under the pleadings and evidence the jury returned a special verdict upon which the court entered judgment dismissing
